1. WHO WE ARE AND AGREEMENT TO TERMS

These Terms and Conditions ("Terms") govern your access to and use of Unikaway.com ("Unikaway," "we," "us," or "our") and any travel bookings made through our platform. By accessing our site, using our services, or completing a booking, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our website or services.

2. ROLE AS AN INTERMEDIARY AGENCY

Unikaway acts solely as an independent travel booking intermediary. We aggregate and display travel products—including flights, hotels, cruises, car rentals, transfers, and tours—provided by independent third-party suppliers ("Travel Suppliers"). We do not own, operate, manage, or control any of the travel services listed on our platform. Your booking creates a direct, binding contractual relationship between you and the respective Travel Supplier, and their specific terms and conditions apply to your reservation alongside these Terms.

3. BOOKINGS, CONFIRMATIONS, AND SYSTEM ERRORS

A booking is only confirmed when we issue a written confirmation containing a valid booking reference number. Until a confirmation is issued, prices, schedules, and availability remain subject to change without notice.

Pricing & System Errors ("Mistake Fares"): In the event of an obvious pricing error, system glitch, or incorrect rate displayed due to technical failure, Unikaway and its Travel Suppliers reserve the right to cancel any affected pending or confirmed booking. If canceled under these circumstances, your sole remedy is a full refund of any funds paid toward that specific booking, without further financial or legal liability on the part of Unikaway.

4. PRICES, TAXES, AND SERVICE FEES

Prices displayed on Unikaway.com may be shown as a base rate plus an itemized line item labeled "Taxes & Fees," "Taxes & Service Fees," or "Tax Recovery Charge & Service Fee."

Composition of Fees: The "Taxes & Fees" portion includes an estimate of applicable government taxes (such as sales, room, occupancy, or value-added taxes) remitted to Travel Suppliers or taxing authorities, combined with an administrative service fee and markup retained by Unikaway as compensation for facilitating and servicing your booking.
Local Direct Fees: Certain destination charges—including local resort fees, city occupancy taxes, cleaning fees, or incidental security deposits collected directly by hotels or cruise lines upon check-in—are not included in your prepaid total and remain your sole responsibility.

5. CANCELLATIONS, MODIFICATIONS, AND REFUNDS

All requests for booking modifications, name changes, date changes, or cancellations are governed strictly by the respective Travel Supplier's specific policies and procedures.

Non-Refundable Agency Fees: Any administrative service fees, processing charges, or markups retained by Unikaway within the booking price or "Taxes & Fees" portion are strictly non-refundable. Where a refund is authorized and issued by a Travel Supplier, Unikaway will process the refund back to your original payment method only after receiving the cleared funds from the Supplier.

6. TRAVEL DOCUMENTS, HEALTH, AND ENTRY REQUIREMENTS

You are solely responsible for verifying, obtaining, and holding all required travel documentation for your entire itinerary. This includes, but is not limited to:

Passports with adequate validity (typically at least 6 months beyond your scheduled return date).
Required entry visas, transit visas, or travel authorizations (e.g., ESTA, ETIAS).
Health requirements, medical clearances, and entry certifications.

Unikaway accepts no responsibility or liability if you are denied boarding, transit, or entry into any country or jurisdiction due to invalid or missing documentation.

7. CHARGEBACKS AND PAYMENT DISPUTES

By completing a booking on Unikaway.com, you agree not to file unauthorized or fraudulent credit card chargebacks for non-refundable bookings, merchant delays caused by Travel Suppliers, or travel disruptions outside of Unikaway's direct control. If an improper chargeback is initiated, Unikaway reserves the right to recover all associated merchant dispute fees, chargeback recovery charges, collection costs, and reasonable legal expenses.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Unikaway shall not be held liable for any direct, indirect, incidental, special, punitive, or consequential damages resulting from Travel Supplier insolvencies, cancellations, flight delays, schedule changes, personal injury, illness, property damage, or events of force majeure (including weather delays, acts of God, civil unrest, or government restrictions).

In all events, Unikaway's total aggregate liability to you shall not exceed the net administrative service fee retained by Unikaway for the specific booking giving rise to the claim.

9. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by, structured, and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising under or relating to these Terms or your use of Unikaway.com shall be brought exclusively in the state or federal courts located in Fulton County, Georgia.

10. CHANGES TO THESE TERMS

We reserve the right to modify or update these Terms at any time without prior notice. The version published on this page at the time your booking is completed will govern that transaction.
